Terms of Service

Acceptance of Terms

By accessing or using the NxtStepEdu platform — including our web application, mobile apps, and any related services — your school, its staff, parents, and students agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use the platform.

School Eligibility & Accounts

NxtStepEdu is intended for use by registered educational institutions in India and their authorised staff, students, and parents.

• The school administrator is responsible for creating and managing accounts for teachers, parents, and students.
• Each user must keep their login credentials confidential and is responsible for activity under their account.
• Accounts must be deactivated promptly when a staff member, parent, or student is no longer associated with the school.

Use of the Service

NxtStepEdu provides tools for attendance tracking, fee collection, academic record management, communication, transport tracking, RFID-based access, and learning management, tailored to each user role.

• The service must be used only for legitimate school administration and educational purposes.
• Schools are responsible for ensuring the accuracy of data entered, including student records, grades, and fee structures.
• Access to AI-powered features (such as academic insights and risk alerts) is provided as a supplementary tool and does not replace the professional judgment of teachers and administrators.

Fees & Payments

Fee collection within the platform is processed through Razorpay, a third-party payment gateway.

• Parents are responsible for ensuring payment details entered are accurate and for any charges incurred during transactions.
• NxtStepEdu is not responsible for delays or failures caused by banks, payment networks, or Razorpay's systems.
• Settlement of collected fees to the school's bank account typically occurs on a T+2 day basis, subject to Razorpay's processing timelines.
• Subscription fees for the NxtStepEdu platform itself are governed by the commercial agreement signed during onboarding.

User Content & Data

Schools retain ownership of all student records, academic data, and content uploaded to the platform, including assignments, grades, and communications. By using NxtStepEdu, schools grant us a limited license to host, process, and display this data solely for the purpose of providing the service. Our handling of personal data is further described in our Privacy Policy.

Acceptable Use

Users agree not to:

• Upload false, defamatory, or inappropriate content to assignments, messages, or profiles.
• Attempt to access data belonging to other schools, students, or staff without authorisation.
• Reverse-engineer, scrape, or interfere with the platform's normal operation.
• Use the RFID, GPS tracking, or attendance features for any purpose other than legitimate school administration.

Service Availability

We aim to maintain high platform availability (targeting 99.9% uptime) but do not guarantee uninterrupted access. Scheduled maintenance will be communicated to school administrators in advance where possible. We are not liable for temporary unavailability caused by factors outside our reasonable control, including internet outages or third-party service disruptions.

Intellectual Property

The NxtStepEdu name, logo, software, and platform design are the intellectual property of NxtStepEdu and may not be copied, modified, or redistributed without prior written permission. Schools are granted a non-exclusive, non-transferable right to use the platform for the duration of their subscription.

Limitation of Liability

NxtStepEdu provides the platform on an "as is" basis. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from use of the platform, including but not limited to data entry errors, third-party payment issues, or decisions made based on AI-generated insights. Our total liability in connection with the service shall not exceed the fees paid by the school in the preceding twelve months.

Termination

Either party may terminate the service agreement in accordance with the terms of the school's subscription contract. Upon termination, schools may request an export of their data within a reasonable period before it is removed from our systems, subject to legal retention requirements described in our Privacy Policy.

Governing Law

These Terms of Service are governed by the laws of India. Any disputes arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the courts located in India.

Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in our services or legal obligations. Continued use of the platform after changes take effect constitutes acceptance of the revised terms. Material changes will be communicated to school administrators in advance.
